Terms of Sale

These Terms of Sale (“Terms”) apply to purchases made through arrivedaliens.com (the “Site”). The Site is operated by Arrived Aliens LLC (“Arrived Aliens,” “we,” “us,” or “our”). By requesting a quote, placing an order, and/or paying an invoice issued by us, you agree to these Terms.

How ordering works

The Site may list Products with an “Inquire” option instead of online checkout.
Submitting an inquiry is not an order and does not create a binding purchase agreement.
We may respond with a written quote outlining price, specifications, lead time estimate, and shipping (if applicable). Quotes are valid for the time stated in the quote; if no time is stated, they are valid for 7 days.
An order is accepted only when we confirm the order details in writing (email is sufficient) and issue an invoice.
The purchase agreement becomes binding when we receive cleared payment for the invoice, unless we explicitly agree otherwise in writing.

Pricing and what’s included

Prices are provided by quote and confirmed by invoice. Shipping, insurance, taxes, and duties are included only if the quote/invoice explicitly says so.
Prices may change at any time; only the price on your accepted quote/invoice applies to your order.
If we discover an error in a quote or invoice (pricing, shipping, availability, or description), we may correct it or cancel the invoice and refund any amounts received.

Payment (bank transfer only)

We accept bank transfer / wire transfer only to the bank details listed on our invoice.
Payment must be made in full, unless the invoice explicitly states a deposit/payment schedule.
You are responsible for any bank fees, intermediary fees, and currency conversion fees so that the net amount received matches the invoice total.
Production and/or shipment timelines start when payment is received and cleared in our bank account.

Taxes, duties, and import charges

Any applicable US sales tax will be stated on the invoice if required by law.
For international orders, you are responsible for import duties, VAT, customs fees, brokerage fees, and local taxes, unless explicitly stated otherwise in writing.
We do not refund duties/taxes charged by your country.

Product descriptions and handmade variation

We aim to represent Products accurately (photos, dimensions, finishes). However, screens and lighting can affect how Products appear.
Many pieces are handmade and/or produced in small runs. Natural variation in surface, texture, tone, and small irregularities are inherent to the process and not considered defects.
If you have a critical requirement (exact tone, exact grain, or precise matching), contact us before we confirm your order.

Lead times and production

Any lead time provided is an estimate, not a guarantee, unless we explicitly state a fixed delivery date in writing.
Lead times may shift due to production realities (material availability, curing times, kiln schedules, quality control). If there is a material delay, we will notify you.

Shipping, delivery, and inspection window

Shipping method, cost, and insurance (if offered) will be stated in your quote/invoice or agreed in writing.
Delivery dates are estimates. We are not responsible for carrier delays, weather events, customs holds, or other circumstances outside our control.
Please inspect the package and Product upon delivery and report shipping damage within 48 hours of receipt. If you report damage, include your invoice number and clear photos of the outer packaging, inner packaging, and the damage.

Returns, refunds, and warranty

Returns, refunds, and exchanges (if offered) are governed by our Returns & Refund Policy, which is incorporated into these Terms by reference. Unless we agree otherwise in writing, made-to-order and custom pieces are final sale, except where applicable law requires otherwise.

Where applicable, Products are covered by our Limited Warranty (and/or the product manual). Warranty terms, conditions, exclusions, and the claims process are incorporated into these Terms by reference.

Cancellations and changes

Order changes or cancellations are only possible if confirmed by us in writing. For made-to-order/custom pieces, changes or cancellations may not be possible once production has started. If we approve a cancellation after work has begun, we may retain a reasonable amount to cover labor, materials, and costs already incurred, where permitted by law.

Disclaimer and limitation of liability

To the fullest extent permitted by law, Products and the Site are provided “as is” and “as available.”
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages (including loss of profits or loss of use).
Our total liability related to any Product/order will not exceed the amount you paid for the Product giving rise to the claim.
Some jurisdictions do not allow certain limitations, so these may not fully apply to you.

Force majeure

We are not responsible for delays or failure to perform due to events beyond our reasonable control (including natural disasters, fire, supply disruptions, carrier interruptions, government actions, or customs delays).

Intellectual property

All Site content (including text, images, product designs, and documentation) is owned by Arrived Aliens LLC or used with permission and is protected by applicable intellectual property laws. Purchasing a Product does not grant you any rights to reproduce, distribute, or commercially exploit our content or designs.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Florida, except where applicable consumer law requires otherwise.

Updates

We may update these Terms from time to time. The version in effect at the time your invoice is paid will apply to that order. The “Last updated” date reflects the current version.
